I am being very firm with myself. I will not waste more frustration on the Orphan Works issue. No, my article will not get much press and very few people will post links to it, because it is not FULL OF CAPS and it doesn't foretell doom. It's also accurate. How dull. If I feel like sharpening a spork, I shall instead work on the Fair Use article - much more useful.

Come on, Mr UPS guy! Where's my tea?? Orders of this size and relative risk are always nail-biting.

I think your article is absolutely the best, most comprehensive, well-researched and non-alarmist one that I've read. And I'm really glad you posted this, actually, because I read it at work when the issue first came out and meant to link to it, but got distracted with work-stuff and completely forgot.

I love your article. I'm very sad that the charge against the bill is being led with a lot of dangerous misinformation.

I have deep concerns about it, and on balance think its a bad thing. But its not ZOMG UR GONNA LOSE UR COPYRIGHT.

The people most upset about it have really damaged their cause by presenting their case with so much ZOMGing and 'facts' that just plain aren't true. Even the template letters I've seen are so full of misinformation that if I were a senator getting a copy I'd circular file it as hysteria. There are valid concerns with the wording, but the initial outcry has spread so much mistaken information that it's hard to see.

What *I'd* like to see added to the bill is a clause that the infringer isn't protected unless they had no clear and equal alternate. That would protect things that the infringer could have substituted with properly licensed work and allow things like historical or personal photographs.

But I do have a question. Given that it's on the Zine, and the Zine's archives are only available to registered folks and some parts just to subscribers, will the article "disappear" in June?

Oh, good point. It would be available to anyone who registered (free), but I wonder if I can make an exception for this one so it's publicly available... I'll have to poke at the code before the end of the month.
